Terms of use

The short version. Priora Active is a notebook for your training. It is free, it is not medical advice, and your data is yours. Use it sensibly and it will not get in your way.

1. The agreement

These terms are between you and northOS (Mark Pernitsch), the maker of Priora Active. By downloading or using the app you accept them. If you do not, please do not use the app.

The app is distributed through Apple's App Store, so Apple's Licensed Application End User Licence Agreement also applies. Where these terms and Apple's standard EULA disagree, these terms govern the parts they are allowed to govern, and Apple's govern the rest.

2. Your licence

You get a personal, non-transferable, non-exclusive licence to use Priora Active on Apple devices you own or control, as permitted by the App Store terms. You may not resell it, rent it, reverse engineer it, or strip out its branding and pass it off as something else.

3. Not medical advice

This is the part worth reading twice.

Priora Active is a record-keeping tool. It is not a medical device, it is not a coach, and nothing in it is medical, physiotherapeutic or clinical advice.

Lifting weights carries a risk of injury. You are responsible for your own training decisions. If something hurts, or you are unsure whether an exercise is safe for you, speak to a qualified professional rather than to a phone.

4. Your content

Everything you write, log or photograph in the app remains yours. We claim no ownership or licence over it. As described in the privacy policy, it stays on your device and in your own iCloud — we never receive it, so we could not use it even if we wanted to.

Keeping it safe is therefore also, to a real extent, yours: if you turn off iCloud sync and then delete the app, that data is gone and we cannot recover it for you.

5. Price

Priora Active is free to download and free to use. If paid features are ever added, existing functionality will not be taken away and put behind a paywall — anything you can do today you will still be able to do. Any purchases would be handled by Apple, and Apple's refund policy would apply.

6. Availability, and no warranty

The app is provided "as is". We do our best to make it correct and reliable, and we test it before it ships, but we do not warrant that it will be uninterrupted, error-free, or that every number it displays is free of mistakes. Features may change or be removed between versions.

To the fullest extent the law allows, northOS is not liable for indirect, incidental or consequential loss arising from your use of the app — including lost data, lost training history, or injury sustained while training. Nothing here limits liability that cannot lawfully be limited.

7. Apple

Apple is not a party to these terms and has no obligation to provide support for Priora Active. Apple is a third-party beneficiary of these terms and may enforce them against you. Any claim about the app — including product liability, or a failure to meet a legal requirement — is directed to northOS, not to Apple.

8. Ending it

You can stop using the app at any time by deleting it. We may stop distributing or supporting the app, or a particular version of it, at any time; if we do, the copy on your device keeps working until it no longer runs on a future version of iOS.

9. Changes to these terms

If these terms change, the date at the top changes with them, and the current version always lives at this address.

10. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. This does not remove any protection you have under the mandatory consumer law of the country you live in.
